Agreement to Terms

By using the services of Stonewall La Porte Landscaping, you agree to these Terms of Service. If you do not agree with any part of these terms, please do not use our services. We reserve the right to update these terms at any time, and your continued use of our services means you accept any changes.

Services Provided

Stonewall La Porte Landscaping provides professional landscaping services including but not limited to lawn care, landscape design and installation, hardscaping, irrigation systems, tree services, and related outdoor maintenance. Specific services will be outlined in your service agreement or estimate.

We will perform services in a professional manner using industry-standard practices. We reserve the right to refuse service or cancel agreements if site conditions are unsafe or if project requirements fall outside our scope of work.

Scheduling and Access

We will make reasonable efforts to perform services on scheduled dates, but weather conditions, equipment issues, or other circumstances may require rescheduling. We will notify you as soon as possible if schedule changes are necessary.

You agree to provide clear access to work areas during scheduled service times. This includes unlocking gates, moving vehicles or obstacles, and ensuring pets are secured. If access is not available at the scheduled time, rescheduling fees may apply.

Payment Terms

Payment is due upon completion of services unless other arrangements have been made in writing. For recurring services, payment is due according to the schedule outlined in your service agreement. For larger projects, we may require a deposit before starting work.

Late payments may be subject to interest charges or service interruption. We accept payment by cash, check, or credit card. Returned checks will incur a processing fee.

If you have concerns about charges or billing, please contact us within 10 days of receiving your invoice. We will work with you to resolve any issues promptly.

Property Damage and Liability

We carry liability insurance and take care to protect your property during service. If damage occurs due to our negligence, we will repair or reimburse you according to the terms of our insurance policy.

You are responsible for marking or identifying any underground utilities, irrigation lines, invisible fences, or other hidden features before we begin work. We are not liable for damage to unmarked or undisclosed features.

Pre-existing damage or conditions that we did not cause are not our responsibility. We will notify you of any damage we discover during service.

Plant and Material Warranty

Plants, sod, and other living materials come with a limited warranty against defects. Warranty periods vary by material and will be specified in your service agreement. The warranty does not cover damage from improper watering, weather events, pests, disease, or neglect after installation.

You are responsible for providing adequate water and care to new plantings as instructed. Hardscape materials like pavers and stone are warrantied against defects in workmanship but not against settling, frost heave, or other natural ground movement.

Service Cancellation

For recurring services, you may cancel at any time with written notice. We require at least 7 days notice to process cancellations and stop scheduled services.

For one-time projects or installations, cancellation fees may apply depending on how much work has already been completed or materials purchased. We will provide details on cancellation terms in your project estimate.

Limitation of Liability

Our total liability for any claim arising from our services is limited to the amount you paid for the specific service that gave rise to the claim. We are not liable for indirect, incidental, or consequential damages. Some states do not allow limitations on certain damages, so this may not apply to you.

Dispute Resolution

If a dispute arises, we encourage you to contact us directly so we can work toward a resolution. Most issues can be resolved through open communication. If we cannot reach an agreement, disputes will be resolved through binding arbitration in accordance with Texas law.
